Terms of Use

Effective from 1 October 2026. Earlier versions are available in the version archive in the Service.

Definitions

Exerizon (also: we, Service Provider) – Exerizon P.S.A. (a simple joint-stock company under Polish law) with its registered office in Warsaw, ul. Grzybowska 5A, 00-132 Warszawa, Poland, tax ID (NIP): 5223288319, REGON: 527780576, e-mail: office@exerizon.com.

Service – the Exerizon website available at exerizon.com, including its subpages and subdomains.

User (also: you) – any person who uses the Service.

Content – all texts, articles, case studies, graphics, videos, logos, downloadable materials, software and other materials published in the Service.

Terms – these Website Terms of Use. They are the terms and conditions for the provision of services by electronic means within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.

Consulting Agreement – a separate agreement under which Exerizon provides consulting, implementation, engineering or other professional services to a client. Consulting Agreements are not concluded through the Service and are not governed by these Terms.

§1 Who we are and what these Terms cover

1. Who runs the Service. The Service is run by Exerizon, an enterprise technology consultancy based in Warsaw. Our full company details are given in the Definitions.

2. What the Service is. The Service is an informational website: it presents who we are, what we do, our solutions, case studies and insights, and it lets you contact us and find our job openings. There is no registration, no user account and nothing is sold through the Service.

3. What these Terms cover. These Terms set out the rules for using the Service and the free services we provide through it (§2). They do not cover our professional services, which are always governed by a Consulting Agreement concluded separately and in writing.

4. Agreement to the Terms. By using the Service you agree to these Terms. If you do not agree to them, please do not use the Service. The Terms are available free of charge in the Service at any time, in a form that allows you to download, save and print them.

§2 Services provided through the Service

1. Free services. Through the Service we provide, free of charge, the following services by electronic means:

  1. browsing the Content: access to the information published in the Service,

  2. contact form: sending us an enquiry, described in §4,

  3. downloadable materials: where the Service offers reports, whitepapers or other materials for download, access to them on the conditions stated next to the material (some may require providing an e-mail address),

  4. newsletter: if the Service offers a newsletter, receiving our insights and event information by e-mail, on the basis of your consent, which you can withdraw at any time via the link in every message.

2. Conclusion and termination. The agreement for browsing the Content is concluded when you open the Service and ends when you leave it. The agreement for the contact form is concluded when you submit the form and ends when we answer your enquiry or the matter is closed. The agreement for the newsletter is concluded when you confirm your subscription and ends when you unsubscribe. You may stop using any of the services at any time, without giving reasons.

3. Availability. We make reasonable efforts to keep the Service available continuously. We may, however, suspend or restrict access temporarily for maintenance, updates or security reasons, and we may change, add or withdraw features and Content at any time.

§3 Technical requirements and rules of use

1. What you need. To use the Service you need a device connected to the internet with a current version of a popular web browser that supports JavaScript and, for the contact form and newsletter, an active e-mail address. Some Content (e.g. embedded videos) may require your consent to load third-party content.

2. Risks. Using services provided by electronic means carries typical risks: malware, phishing, interception of unencrypted transmission. We protect the Service with TLS encryption and monitor it for abuse; you should keep your device and browser up to date and be cautious of messages impersonating us. We never ask for passwords or payment details through the Service.

3. Prohibited content and conduct. You may not use the Service to provide unlawful content or in a way that disrupts its operation. In particular you may not:

  1. send through the contact form content that is unlawful, offensive, defamatory or infringes third-party rights,

  2. send unsolicited commercial information (spam) or mass, automated submissions,

  3. attempt to gain unauthorised access to the Service, its infrastructure or the data of other Users, or test its security without our written consent,

  4. copy the Service or its Content by automated means (scraping, crawling) beyond what search engines do to index public pages, including for the purpose of training machine-learning models,

  5. interfere with the Service's code, disable its security features or impersonate Exerizon or its people.

4. Consequences. If you breach these rules we may block your access to the Service or to particular features and, where required, notify the competent authorities.

§4 Contact form and correspondence

1. How it works. The contact form in the Service lets you send us your name, e-mail address and a message. Submitting the form is a request for us to contact you; it does not conclude a Consulting Agreement or any other agreement for paid services.

2. What happens next. We read every enquiry and aim to respond within a few business days to the e-mail address you provided. If your enquiry concerns our services, we may ask follow-up questions and, if you wish, prepare a proposal. Any commitment on our side arises only when a Consulting Agreement is signed.

3. Confidentiality. Please do not send confidential business information, personal data of third parties or access credentials through the contact form. If a matter requires exchanging confidential information, we will first agree a non-disclosure agreement with you.

4. Direct e-mail. You can also write to office@exerizon.com. The rules of this section apply to such correspondence accordingly.

§5 Content, copyright and trademarks

1. Our rights. The Content is protected by copyright, trademark and other intellectual property laws. Unless indicated otherwise, the rights to the Content belong to Exerizon or its licensors. All rights not expressly granted in these Terms are reserved.

2. What you may do. You may view, download and print the Content for your own informational, non-commercial purposes and for the internal needs of your organisation, provided that you do not modify it and keep all copyright notices and attributions. You may share links to the Service.

3. What you may not do. Without our prior written consent you may not reproduce the Content in whole or in substantial part for commercial purposes, distribute it, publish it on other websites, translate it, create derivative works from it, remove attributions, or use any software, methodology, proprietary process or technology described or embodied in the Service.

4. Case studies and insights. Case studies describe specific projects and their context; they are illustrative and do not promise that the same results can be achieved in a different organisation. Insights and articles express the views of their authors at the time of writing and may not be updated.

5. Our trademarks. "Exerizon", the Exerizon logo and the names of our products and services are trademarks or trade names of Exerizon. You may not use them in any way that suggests endorsement, affiliation or sponsorship without our written consent.

6. Third-party trademarks. References in the Service to third-party products, platforms and brands (for example cloud, data or low-code platforms we work with) are for identification purposes only. They are trademarks of their respective owners, and their presence does not mean that those owners have approved the Service or its Content. These Terms grant you no right to use them.

7. Feedback. If you send us ideas or suggestions about the Service or our services, you agree that we may use them without obligation to you, unless we agree otherwise in writing.

§6 Information only: no professional advice

1. General information. The Content is provided for general informational purposes only. Through the Service we are not rendering consulting, engineering, legal, tax, financial, regulatory or any other professional advice or services, and nothing in the Service creates a professional or contractual relationship between you and Exerizon.

2. Consult before acting. Before making any decision or taking any action that may affect your organisation's technology, operations, finances or compliance, you should consult a qualified professional advisor, considering your specific circumstances. Our professional services are provided only under a Consulting Agreement.

3. Accuracy. We take care to keep the Content accurate and up to date, but we do not warrant that it is complete, current or free of errors. Statements about regulations, technologies and market conditions may become outdated.

4. Regulated sectors. Content relating to regulated industries (e.g. banking, insurance, healthcare) does not constitute compliance advice and does not establish that any solution described is compliant with regulations applicable to your organisation.

§7 Links to other websites

1. Where links lead. The Service contains links to websites and services operated by third parties, in particular our job openings on an external recruitment platform, our LinkedIn and YouTube pages, and the websites of technology partners.

2. No control. We do not control these websites and are not responsible for their content, availability, security or privacy practices. A link is not an endorsement. When you follow a link, the terms and privacy policy of that website apply.

3. Links to the Service. You may link to the Service's pages, provided that you do so fairly and lawfully, without suggesting affiliation or endorsement and without framing the Service within another site.

§8 Liability

1. As is, within the limits of the law. The Service and the Content are provided "as is". To the fullest extent permitted by law, we make no representations or warranties, express or implied, regarding the Service or the Content, including as to their accuracy, completeness, fitness for a particular purpose, uninterrupted availability or freedom from errors and malicious code.

2. What we are not liable for. To the fullest extent permitted by law, we are not liable for any loss or damage arising from the use of, or inability to use, the Service or the Content, from reliance on the Content, or from the content of linked third-party websites, whether in contract, tort or otherwise. This includes indirect and consequential loss, lost profits and loss of data.

3. What this does not exclude. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, in particular liability for damage caused intentionally, and the statutory rights of consumers. If you are a consumer, the mandatory provisions of the law of your country of residence apply to you where they are more favourable.

4. Your responsibility. You are responsible for your use of the Service and for any content you send us through it, and for ensuring that you have the right to send it.

§9 Complaints

1. How to complain. If you believe the Service or any of the services in §2 is not working as it should, or that we have breached these Terms, you can file a complaint by e-mail to office@exerizon.com or by post to the address in the Definitions. Please describe the problem, indicate the date it occurred and give an e-mail address for our reply.

2. How we respond. We respond to complaints within 14 days of receiving them, to the e-mail address you provided. If we need more information to resolve the complaint, we will ask for it within that period.

§10 Personal data and cookies

1. Privacy Policy. How we process personal data of Users, including data sent through the contact form, is described in the Privacy Policy available in the Service.

2. Cookie Policy. The cookies and similar technologies used in the Service, together with a full inventory and instructions for managing your choices, are described in the Cookie Policy available in the Service.

§11 Governing law and disputes

1. Polish law. These Terms and the use of the Service are governed by the laws of Poland. If you are a consumer, this choice does not deprive you of the protection granted by mandatory provisions of the law of your country of residence.

2. Courts. Disputes arising from these Terms are resolved by the competent Polish common courts. For Users who are entrepreneurs, the court competent for our registered office has jurisdiction. Consumers may bring proceedings before the court competent under general rules.

3. Amicable resolution first. Before going to court, we encourage you to write to us; most matters can be resolved directly.

4. Severability. If any provision of these Terms is found invalid or unenforceable, it shall be construed to give effect to its intent as nearly as the law permits, and the remaining provisions remain in force.

§12 Changes to these Terms and version history

1. When we change them. We may amend these Terms when the law, the features of the Service or our business change. Each version has a number, an effective date and a short description of changes, and earlier versions are archived and available for download in the Service.

2. How we inform you. We publish amended Terms in the Service before they take effect. If you subscribe to the newsletter, we will also inform you by e-mail of changes affecting that service; you may unsubscribe if you do not accept them. Using the Service after the effective date of the amended Terms means you accept them.

3. Language. This document is drawn up in English, which is its sole binding version.
